Overview:
The Texas State legislation on consumer health data Privacy Policy supplements this John Naus M.D., P.A. (“Company”, “we”, “us”) Privacy Policy (“Privacy Policy”) and applies to the extent you are a resident of the state of Texas from whom we collect “consumer health data” (“CHD”), as defined by the prevailing Texas State legislation on consumer health data.
SMS (text) Terms and Conditions: You may be asked to opt in to SMS communication throughout your treatment at John Naus M.D., P.A. By asking for SMS communication or responding to a requested SMS message from John Naus M.D., P.A. you are considered to be consenting to participating and receiving such messages. When sending an unsolicited new SMS(text) asking for a response from our office either directly stated or implied you are also consenting to participate in SMS communication. This includes but is not limited to SMS messages for appointment scheduling, appointment reminders, post-visit instructions, lab notifications, and billing notifications.
When you click YES to SMS communication on our forms, you are opting into SMS (text) and may receive an SMS reply. Upon receiving a text, please respond with “STOP” to any SMS (text) to opt out of SMS (text) communication. At any time, by sending or replying “START” via SMS (text) you will also be consenting and opting into SMS messaging. Consent for SMS messaging can be withdrawn at any time by replying to a text or initiating a new text with “STOP.” When receiving text messages you may text “STOP” to opt out of receiving further SMS messages or call (817) 545-9100, choose option (5), and leave a voice mail stating your choice to opt out of SMS communication. SMS content, participants, phone numbers, and SMS consent are not shared with third parties for marketing purposes. Data we collect:
We collect general data as a consumer website. However, we do not collect data on any single individual’s website activity that is identified with their name or individual signature. Any general website data collected is not linked to an individual. Data collected as a result of a communication or information submission on our website is considered part of an individual’s medical record and as such is used to carry out the agreed-upon medical care and not shared with third parties for marketing purposes. Any patient information is subject to our health information practices policy.
Sources of Internet/transmitted Data:
We collect personal data directly from you on our website only when you make a direct submittal that is either a response to your direct request or a submittal that is directly volunteered and initiated by you. We do not sell any such data and we only disclose such data for carrying out healthcare practice on your behalf. The use of data concerning active or inactive patients is governed by our health information practice policy. (This was agreed on with the initiation of your treatment contract and is available to our patients upon written request.)
Our Disclosure of Consumer Health Data (CHD):
Any Disclosure of patient data is governed by HIPPA. We may disclose data as described in our health information practice policy. We may disclose CHD or other data only to the extent that it identifies you when necessary to your care or when required by law. Most CHD disclosures are made to complete any transaction or to provide you with any product or service you have requested or authorized.
For example, if you obtain services, we will disclose information about the transaction as necessary to process the payment, including protection against fraud. We may disclose data when we believe doing so is to comply with a valid legal process or applicable laws.
Third-Party Disclosure:
As necessary for the purposes described above to provide the Services that you request from us, we disclose information that could be considered CHD with the following categories of third parties:
- Service providers. Vendors, service providers, or contractors (“processors”) that provide services on our behalf may access information that might be considered CHD for any purpose described above. For example, companies providing customer service support or technical services, or those who assist in protecting and securing our systems and services may need access to data to provide those functions on our behalf.
- Financial institutions & payment processors. When you obtain Services or enter into a financial transaction, we will disclose payment and transactional data to banks and other entities as necessary for payment processing, fraud prevention, credit risk reduction, analytics, or other related financial services.
- Parties to a corporate transaction. We may disclose information that might be considered CHD as part of a corporate transaction or proceeding such as a merger, financing, acquisition, bankruptcy, dissolution, or a transfer, divestiture, or sale of all or a portion of our business or assets.
- Affiliates. We may enable access to data across our subsidiaries, affiliates, and related companies, to the extent that access helps to provide our services and operate our business.
- Government agencies. We disclose data to law enforcement or other government agencies when we believe doing so is necessary to comply with the law or to respond to valid legal process.
- Other third parties. It may be necessary to provide data to other third parties, to comply with the law, or to protect our rights or those of our customers.
- Other users and individuals. If you use our services to interact with other users of the Service or other recipients of communications, we may disclose data, including information that might be considered CHD, as directed and requested by you in your interactions.
How to Exercise Your Rights
You may request that we stop any transmission of data that is specific to you and identifies you individually. We cannot limit data transmission that is required by law or that may obstruct any active and lawful legal process. Any such request that limits our ability to conduct business, is related to products and services that you have or will utilize, or may result in a direct or indirect cost to John Naus M.D., P.A. will lead to additional costs of your healthcare that will be considered your responsibility.
