The Texas State legislation on consumer health data Privacy Policy supplements this John Naus M.D., P.A. (“Company”, “we”, “us”) Privacy Policy (“Privacy Policy”) and applies to the extent you are a resident of the state of Texas from whom we collect “consumer health data” (“CHD”), as defined by the prevailing Texas State legislation on consumer health data.
SMS (text) Terms and Conditions:
You may be asked to opt in to receiving SMS communication through your treatment at John Naus M.D., P.A. By asking for any SMS communication response or responding to a requested SMS message from John Naus M.D., P.A. you are considered to be consenting to participating and receiving such messages. When sending an unsolicited new SMS(text) asking for a response from our office, either directly stated or implied, you are also consenting to participate in SMS communication.
SMS Consent Communication: The information (Phone Numbers) obtained as part of the SMS consent process will not be shared with third parties for marketing purposes.
Types of SMS Communications: If you have consented to receive SMS text messages from John Naus M.D., P.A., you may receive messages related to the following:
Appointment Reminders: Example text “Your appointment at John Naus MD PA in Colleyville TX is scheduled for date: 01/23/1945 at 8:00 am. Reply STOP to opt out of SMS messages at any time.”
Medication Refill Notifications: Example text “Your medication from John Naus MD PA has been sent to your pharmacy. Reply STOP to opt out of SMS messages at any time.”
Billing Notifications: Example text “This is John Naus MD PA. Please contact us about your outstanding balance. Reply STOP to opt out of SMS messages at any time.”
General Communications: Example text “This is John Naus MD PA. Your START text was received. Reply “STOP” to opt out of SMS messages at any time. Reply “HELP” for additional assistance.”
Message Frequency: Message frequency may vary depending on the type of communication. For example, you may receive up to (2) SMS text messages a week related to your Appointment Reminders or account status. While you may receive 1-4 messages weekly concerning Billing notifications. However, upon receiving any text from John Naus MD PA, please respond with “STOP” via SMS (text) to opt out of SMS (text) communication.
Potential Fees for SMS text messaging: Please note that standard message and data rates may apply, depending on your carrier’s pricing plan. These fees may vary if the message is sent domestically or internationally.
Opt-in Methods: In any case where you might want to Opt-in to receive SMS text messages from John Naus MD PA, this can be accomplished in the following ways:

Your participation in SMS text messaging is always voluntary and is not required. We will not share your participation in SMS with any third party. The information (Phone Numbers) obtained as part of the SMS consent process will not be shared with third parties for marketing purposes. SMS content, participants, phone numbers, and SMS consent are considered part of your medical chart and your Health information. Data we collect:
We collect general data as a consumer website. However, we do not collect data on any single individual’s website activity that is identified with their name or individual signature. Any general website data collected is not linked to an individual. Data collected as a result of a communication or information submission on our website is considered part of an individual’s medical record and as such is used to carry out the agreed-upon medical care and not shared with third parties for marketing purposes. Any patient information is subject to our health information practices policy.
Sources of Internet/transmitted Data:
We collect personal data directly from you on our website only when you make a direct submittal that is either a response to your direct request or a submittal that is directly volunteered and initiated by you. We do not sell any such data and we only disclose such data for carrying out healthcare practice on your behalf. The use of data concerning active or inactive patients is governed by our health information practice policy. (This was agreed on with the initiation of your treatment contract and is available to our patients upon written request.)
Our Disclosure of Consumer Health Data (CHD):
Any Disclosure of patient data is governed by HIPPA. We may disclose data as described in our health information practice policy. We may disclose CHD or other data only to the extent that it identifies you when necessary to your care or when required by law. Most CHD disclosures are made to complete any transaction or to provide you with any product or service you have requested or authorized.
For example, if you obtain services, we will disclose information about the transaction as necessary to process the payment, including protection against fraud. We may disclose data when we believe doing so is to comply with a valid legal process or applicable laws.
Third-Party Disclosure:
As necessary for the purposes described above to provide the Services that you request from us, we disclose information that could be considered CHD with the following categories of third parties:
- Service providers. Vendors, service providers, or contractors (“processors”) that provide services on our behalf may access information that might be considered CHD for any purpose described above. For example, companies providing customer service support or technical services, or those who assist in protecting and securing our systems and services may need access to data to provide those functions on our behalf.

How to Exercise Your Rights
You may request that we stop any transmission of data that is specific to you and identifies you individually. We cannot limit data transmission that is required by law or that may obstruct any active and lawful legal process. Any such request that limits our ability to conduct business, is related to products and services that you have or will utilize, or may result in a direct or indirect cost to John Naus M.D., P.A. will lead to additional costs of your healthcare that will be considered your responsibility.
